ISIS Penal Code Mandates Death Penalty, Crucifixions, and Amputations

The Islamic State of Iraq and Syria’s penal code, which was recently published on an online jihadi forum, mandates the death penalty for specific crimes. The code was translated into English by the Middle East Media Research Institute (MEMRI).

The terrorist organization’s punishment for “terrorizing people” is exile, a relatively harsh one considering that homosexuals receive the death penalty. The full list of punishments is as follows:

  • Blasphemy against Allah: Death
  • Blasphemy against the Prophet Muhammad: Death – even if the accuser repents
  • Blasphemy against Islam: Death
  • Adultery: Stoning until death in case the adulterer was married and 100 lashes and exile if he or she were unmarried.
  • Sodomy (homosexuality): Death for the person committing the act, as well as for the one receiving it.
  • Theft: Cutting off the hand
  • Drinking alcohol: 80 lashes
  • Slandering: 80 lashes
  • Spying for the unbelievers: Death
  • Apostasy: Death
  • Banditry:
    • 1: Murder and stealing: Death and crucifixion
    • 2: Murder only: Death
    • 3: Stealing (as part of banditry): Cutting off the right hand and the left leg
    • 4: Terrorizing people: Exile

Earlier this month, MEMRI discovered an ISIS pamphlet that gives advice on appropriate behavior towards the women and girls it has kidnapped to serve as sex slaves. The pamphlet notes that if the captured woman “is a virgin, he [her master] can have intercourse with her immediately after taking possession of her. However, is she isn’t, her uterus must be purified [first]…” It also gives approval to the rape of prepubscent girls, explaining that “it is permissible to have intercourse with the female slave who hasn’t reached puberty if she is fit for intercourse.”

According to Iraq’s Human Rights Ministry, ISIS recently killed more than 150 women and girls for refusing to marry jihadis.
